This website is operated by BreatheAssured.com, the trading name of Medical Assured Group Limited. If you continue to browse this website and/or purchase something from us, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern BreatheAssured.com’s relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.


The term ‘BreatheAssured’ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is 10 Hanbury Road, Bristol BS82EW. Our company registration number is 12991100. The term ‘you’ refers to the user or viewer of our website.


The content of the pages of the website is for your general information and use only. We reserve the right to update, change or replace any part of these Terms and Conditions without notice.


Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.


Where links to other websites are included, they are intended for your convenience and to provide further information. They do not mean that we endorse the website(s) and we have no responsibility for the content of the linked website(s).

Any material downloaded or otherwise obtained through the use of this website is done so at your own discretion and risk.


ORDERS

When you place an order with us, we will acknowledge and confirm by email that we have received your order, giving details about the goods and prices charged, information about the progress of your order and estimated dispatch and delivery information. Our acceptance of your order will only cover the goods mentioned in it and may not cover all the goods ordered. If this is the case, the order you made for the remaining goods will only be accepted when we send a further email acceptance of that part of your order. We reserve the right to decline or cancel an order for any reasons at our sole discretion, including without limitation: insufficient stock to deliver the goods ordered, no delivery can be arranged for your area, prices of one or more goods ordered were incorrectly listed.


AVAILABILITY OF GOODS

All goods are subject to availability and may be withdrawn at any time. We will not be held responsible for any losses you may suffer if we are unable to supply the ordered goods.


DESCRIPTION OF GOODS

Whilst we have exercised all reasonable care to ensure that details, descriptions and prices on our website are correct, errors may occur and we reserve the right to alter these at any time. We also reserve the right to change the specification of the goods we sell at any time.


FAULTY OR DAMAGED GOODS

Where goods received by you are faulty, defective or damaged with no fault on your part, or if the goods are not what you ordered or are of an incorrect quantity, we must be notified within 30 days of receipt in order for replacement goods to be delivered free of charge. No claim will be accepted outside this time limit. All goods are returned to us at your risk.


We recommend you book your test supervision appointment as early as possible within the 72 hour window prior to travel in case of the rare event of a problem with your test (N.B some countries stipulate a 48 hour window).


There is a 1-2% chance of an invalid test. An invalid test can be caused by a deteriorated test or a failure to follow instructions properly or poor sample collection.  An invalid test result is shown by the failure of the quality control ‘C’  line to appear, even if the detection line ‘T’ appears.


In the event of an invalid test that is deemed a product error we will do our best to rectify the issue in a number of ways:

  1. If you have purchased additional tests, and have one available to use, we will offer a repeat test supervision immediately or later if required, using that test, and replace or refund the invalid one as preferred.
  2. If you do not have a spare test available, we will endeavour to supply you with another test kit and appointment within 24 hours.
  3. However, if your flight is within 24 hours, this might not be sufficient. In this case we will refund the cost of test and postage and pay for you to take the test at your departure airport up to a cost of £60.

If the invalid test is a result of failure to follow the instructions of our nurses, we have a no refund policy.


PRICES

All prices quoted are for new goods; prices are in pounds sterling and include all taxes at current rates. Prices are subject to change at any time before we accept an order from you.

DELIVERY

We only make deliveries for UK mainland. All quoted delivery times are estimates only. All goods shall remain our property (notwithstanding delivery and the passing of risk) until paid for. Once the goods have been delivered to you they will be held at your own risk and we will not be liable for any loss or damage.


We do not hold any responsibility if the wrong address is provided on purchase so please ensure details are correctly entered. Your delivery is tracked and you will be provided with the tracking reference. If you are unable to take delivery then please ensure you leave instructions for the delivery service.


If you have entered the incorrect details and the product has not yet been dispatched, we will endeavour to change the delivery address. However, if already dispatched we are unable to change details.


If the parcel is undeliverable, it will be returned to sender. We can redispatch the products, but a new delivery charge will need to be paid by the customer and this will obviously result in a delay.


Unfortunately, we are unable to provide refunds on tests unless faulty.

 

CARD PAYMENT

Payment must be made by one of the following: Mastercard, Visa, Maestro or PayPal. Payment for the products and all applicable delivery charges must be made in advance.


We use a third-party payment service to process online payments. Credit and debit card information is always encrypted when your order is placed. All card and payment details are securely processed and none of your details will be passed onto any third party or used for any other purpose other than those that have been authorised by you.


PERSONAL INJURY

All goods supplied must be used strictly in accordance with any applicable instructions. Except where we are negligent, we accept no liability for injury or damage caused by the improper use of any goods.


PRIVACY POLICY

Personal information provided or collected through or in connection with this website shall only be used in accordance with and are subject to the Privacy Policy as posted on this website.


INTELLECTUAL PROPERTY

The intellectual property rights on the content, user content, design, text, graphics and other material on this website are owned, controlled, or licensed by or to us. Any unauthorised use without our prior written consent is strictly prohibited.


LIMITATION OF LIABILITY

In no event shall BreatheAssured.com or Medical Assured Group Limited, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any direct, indirect, incidental, punitive, special or consequential or other damages resulting from, arising out of or in connection with the access, use of, or inability to access or use this website.
